Terms of Service

Welcome to SiteSkills ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the SiteSkills platform, website at siteskills.ai, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing the marketplace, uploading a skill, downloading a skill, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.

2. Account Registration and Responsibilities

2.1 Eligibility

You must be at least 13 years of age to use the Service. By registering, you represent and warrant that you meet this age requirement.

2.2 Account Creation

You may create an account using an email address and password, or by authenticating through a supported third-party provider (GitHub OAuth or Google OAuth). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Account Security

You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials secure and confidential.
  • Notify us immediately at support@siteskills.ai if you suspect any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account, whether or not authorized by you.

2.4 One Account Per Person

Each individual may maintain only one account. We reserve the right to merge or terminate duplicate accounts.

3. The Skill Marketplace

3.1 Overview

SiteSkills is a marketplace where creators publish browser automation skills packaged as ZIP archives containing JavaScript or TypeScript code. Users can browse, download, and run these skills using AI browser agents.

3.2 Uploading Skills

Creators may upload skills to the marketplace subject to these Terms. By uploading a skill, you grant SiteSkills a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote the skill on the platform. This license is limited to operating and promoting the Service and does not transfer ownership of your intellectual property.

3.3 Downloading and Using Skills

Users may browse and download skills from the marketplace. Downloaded skills are licensed to you by the skill's creator under the license terms specified by that creator. SiteSkills does not claim ownership of third-party skills and is not a party to the license agreement between creators and users, except as expressly stated in these Terms.

3.4 Skill Licensing

Creators must specify a license for each skill they publish. If no license is specified, the skill is made available under a default "all rights reserved" license, granting users only the right to download and use the skill for its intended purpose with compatible AI browser agents.

4. Creator Responsibilities

As a skill creator, you represent, warrant, and agree that:

4.1 Intellectual Property Ownership

  • You own or have obtained all necessary rights, licenses, and permissions for all content included in your skill.
  • Your skill does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
  • You are solely responsible for any claims arising from your skill's content or functionality.

4.2 Prohibited Content

Your skill must not:

  • Contain malicious code, malware, viruses, trojans, ransomware, spyware, or any other harmful components.
  • Perform unauthorized data collection, exfiltration, or surveillance.
  • Attempt to exploit vulnerabilities in users' systems, browsers, or connected services.
  • Circumvent or interfere with the security features of any website, service, or system.
  • Violate any applicable law, regulation, or third-party terms of service.
  • Contain or distribute illegal, defamatory, harassing, or otherwise objectionable content.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4.3 Accurate Descriptions

You must provide accurate, truthful, and complete descriptions of your skill's functionality. Misrepresenting what a skill does is a violation of these Terms and grounds for immediate removal and potential account termination.

4.4 Ongoing Maintenance

While not required, creators are encouraged to maintain and update their published skills. SiteSkills reserves the right to label skills as unmaintained or to remove them if they become incompatible or pose a risk to users.

5. User Responsibilities

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to violate any applicable local, state, national, or international law or regulation.
  • Use downloaded skills for any purpose that is illegal, harmful, or prohibited by these Terms.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service (except to the extent permitted by applicable law).
  • Interfere with, disrupt, or place an undue burden on the Service or its infrastructure.
  • Use automated means (bots, scrapers, etc.) to access the Service in a manner that exceeds reasonable use, except through supported AI browser agent integrations.
  • Resell, redistribute, or sublicense skills obtained from the marketplace unless the skill's license explicitly permits it.
  • Circumvent any access controls, payment mechanisms, or usage restrictions.

5.2 Assumption of Risk

Skills on the marketplace are created by third-party developers. While we take measures to review and moderate skills, you acknowledge that you download and run skills at your own risk. We recommend reviewing a skill's source code, ratings, and reviews before use.

6. Payment Terms

6.1 Paid Skills

Creators may offer skills for free or set a price for paid skills. When you purchase a paid skill, you agree to pay the listed price at the time of purchase. All prices are displayed in US dollars unless otherwise indicated.

6.2 Platform Fee

SiteSkills charges a 15% platform fee on all paid skill transactions. Creators receive 85% of the sale price. Payouts to creators are processed according to our standard payout schedule and are subject to minimum payout thresholds.

6.3 Pro Subscription

SiteSkills offers a Pro subscription tier that provides access to premium features. By subscribing to Pro, you agree to pay the applicable subscription fees on a recurring basis. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select.

You may cancel your Pro subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period, after which your account will revert to the free tier.

6.4 Payment Processing

All payments are processed through our third-party payment processor, Stripe. By making a purchase or subscribing, you agree to Stripe's terms of service. SiteSkills does not store your full payment card details on our servers.

6.5 Taxes

You are responsible for any applicable taxes associated with your use of the Service, including purchases of paid skills or subscriptions.

7. Refund Policy

7.1 Paid Skills

You may request a refund for any paid skill within 7 days of purchase. Refund requests can be submitted by contacting support@siteskills.ai. To be eligible for a refund, you must provide your order details and a brief explanation of the reason for the request.

Refunds are processed at our discretion. Valid reasons for refunds include but are not limited to:

  • The skill does not function as described.
  • The skill contains critical bugs that prevent its intended use.
  • The skill was purchased by mistake (e.g., duplicate purchase).

7.2 Pro Subscription

Pro subscription refunds are handled on a case-by-case basis. If you cancel within 48 hours of your initial subscription or a renewal and have not made significant use of Pro features, you may be eligible for a refund. Contact support@siteskills.ai to request a subscription refund.

7.3 Refund Processing

Approved refunds are processed through the original payment method via Stripe. Please allow 5-10 business days for the refund to appear on your statement. The platform fee is included in the refund (i.e., creators will have the corresponding amount deducted from their balance).

8. Content Moderation and Removal

8.1 Review Process

SiteSkills reserves the right to review, screen, and moderate all skills published on the marketplace. We may use automated tools, manual review, or a combination of both to identify skills that violate these Terms.

8.2 Removal of Skills

We may remove or disable access to any skill at any time, with or without notice, if we reasonably believe that the skill:

  • Violates these Terms or any applicable law.
  • Contains malicious or harmful code.
  • Infringes upon the intellectual property or other rights of a third party.
  • Poses a security risk to users or the platform.
  • Has been the subject of valid complaints or reports.

8.3 Reporting Violations

Users and third parties may report skills that they believe violate these Terms by contacting support@siteskills.ai. We will review all reports promptly and take appropriate action.

9. DMCA and Intellectual Property Takedown Process

9.1 Respect for Intellectual Property

SiteSkills respects the intellectual property rights of others. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

9.2 Filing a DMCA Notice

If you believe that a skill on our marketplace infringes your copyright, please submit a written notification to support@siteskills.ai that includes:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) claimed to have been infringed.
  3. Identification of the infringing material and information reasonably sufficient to locate it on the Service (e.g., a direct link to the skill page).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

9.3 Counter-Notification

If you believe your skill was removed or disabled by mistake or misidentification, you may submit a counter-notification to support@siteskills.ai that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who filed the original DMCA notice.

9.4 Repeat Infringers

SiteSkills will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual property rights.

10. Account Termination

10.1 Termination by You

You may delete your account at any time through your account settings or by contacting support@siteskills.ai. Upon deletion, your profile, uploaded skills, and associated data will be removed in accordance with our Privacy Policy.

10.2 Termination by SiteSkills

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe that:

  • You have violated these Terms.
  • Your account has been used for fraudulent or illegal activity.
  • Your continued use of the Service poses a risk to the platform, other users, or third parties.
  • It is required by law or a valid legal process.

10.3 Effect of Termination

Upon termination of your account:

  • Your right to access and use the Service will immediately cease.
  • Any pending creator payouts may be withheld if the termination is due to a violation of these Terms.
  • Previously purchased skills may continue to function locally but will no longer receive updates or support through the platform.
  • Provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 11, 12, and 13.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SITESKILLS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

SKILLS AVAILABLE ON THE MARKETPLACE ARE PROVIDED BY THIRD-PARTY CREATORS. SITESKILLS DOES NOT ENDORSE, WARRANT, OR GUARANTEE THE QUALITY, SAFETY, ACCURACY, OR LEGALITY OF ANY SKILL, AND IS NOT RESPONSIBLE FOR ANY DAMAGE OR HARM RESULTING FROM YOUR USE OF THIRD-PARTY SKILLS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SITESKILLS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SITESKILLS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SITESKILLS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO SITESKILLS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal proceeding, you agree to first contact us at support@siteskills.ai and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good-faith negotiations for at least 30 days.

13.2 Binding Arbitration

If a dispute cannot be resolved informally, you and SiteSkills agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as otherwise provided herein.

13.3 Class Action Waiver

YOU AND SITESKILLS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Exceptions

Either party may bring an individual action in small claims court for disputes within the court's jurisdiction. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property infringement or unauthorized access to the Service.

13.5 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

14. Indemnification

You agree to indemnify, defend, and hold harmless SiteSkills and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of another party, including intellectual property rights.
  • Any skill you upload or publish on the marketplace.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly referenced herein, constitute the entire agreement between you and SiteSkills regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

The failure of SiteSkills to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. SiteSkills may assign these Terms without restriction.

15.5 Force Majeure

SiteSkills shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, or internet or infrastructure failures.
